New Acas guidance on conducting workplace investigations
A properly conducted investigation is essential when dealing with a potential disciplinary situation or a grievance. A badly managed investigation can lead to an unfair dismissal or disciplinary sanction, or a grievance not being treated appropriately, which can result in disgruntled employees and even costly Employment Tribunal claims.
Investigations can involve a range of issues from misconduct and poor performance to bullying and discrimination. In particular, bullying and discrimination investigations can be complex and involve collating a considerable amount of evidence.
Acas has produced a new guide “Conducting workplace investigations” to help employers carry out a fair and thorough investigation, and facilitate the right decision ultimately being reached. They have also produced some useful template documentation including template letters, and a template investigation plan and report.
